Our Constitutional & Statutory Mandate
Established under Article 229 of the Constitution of Zambia, the Electoral Commission of Zambia is empowered with distinct constitutional functions and statutory duties under Electoral Process Act No. 35 of 2016.
Article 229
Constitutional Functions
- Implement the electoral process across all elections
- Conduct national elections and referenda
- Register eligible citizens as voters
- Delimit electoral boundaries (Constituencies, Wards, and Polling Districts)
- Regulate the conduct of voters, candidates, and political parties
- Accredit election observers, monitors, and election agents
- Settle minor electoral disputes as prescribed by law
- Perform such other statutory functions as prescribed
Act No. 35 of 2016
Statutory Powers
- Make regulations providing for voter registration and the manner of conducting elections
- Constitute Conflict Management Committees and appoint Conflict Management Officers
- Administer and enforce the Electoral Process Act and the Electoral Code of Conduct
- Provide comprehensive voter education throughout Zambia
- Disqualify any political party or candidate found in breach of the Electoral Code of Conduct
- Correct mistakes committed by electoral officers in the tabulation of results within 7 days of declaration
OUR MANDATE
Commission Functions
Executing constitutional and statutory duties to ensure democratic integrity, electoral transparency, and citizen participation across Zambia.
Delimitation
Delimitation is the process of mapping and re-aligning of electoral boundaries.
Voter Registration
The Electoral Act empowers the commission to carry out continuous voters registration.
Voter Education
The Electoral Process Act No. 35 of 2016 Section 80 states that the Commission shall provide Voter Education for an election.
Elections
Formal process by which registered voters cast their ballot to choose an individual to hold office of the President, Mayor, Council Chairperson, Member of National Assembly or Councillor.
Conflict Management
One of the mandates of the Electoral Commission of Zambia (the Commission) is to manage electoral conflicts and resolve disputes. This mandate is set out in section 113 of the Electoral Process Act No.35 2016.
Accreditation
Elections in Zambia are open to observation and monitoring by international and local organisations respectively.
